1. Agreement and contact

These Terms apply when you visit Hostile Homepage, submit content, make a free first claim, start checkout, or purchase a position. They work together with the Rules and Privacy Policy. If the Rules conflict with these Terms, these Terms control.

2. Eligibility

You must be at least 18 years old and able to enter a binding agreement. If you act for a company or another person, you confirm that you have authority to bind them and publish content on their behalf. You may not use the service where doing so would violate applicable law or sanctions.

3. What you are buying

A successful free claim or purchase gives you temporary public placement in one of 25 fixed homepage positions. It is promotional placement, not an endorsement, certification, partnership, or ownership interest in the website. Your placement can be replaced when another buyer pays the valid takeover price.

We do not guarantee traffic, clicks, customers, revenue, search ranking, a fixed duration, exclusive placement, or any other result. Metrics are informational and may include bot traffic, blocked requests, or counting errors.

4. Price, reservation, and payment

An unowned position permits one free first claim. A free claimant must provide an owner name and website hostname that have not been used for another free claim; those checks do not verify that each claimant is a different human. The next takeover costs $5.00, and each later price is 20% above the current owner's payment.

For a paid takeover, Checkout reserves the position and your exact submitted content for 35 minutes. A reservation does not guarantee ownership. Paid placement begins only when Stripe confirms payment and the service safely fulfills the matching reservation.

Stripe processes card payments in US dollars. Stripe's own terms and privacy notice apply to its payment service. We receive transaction references, status, amount, and currency, but not your full card number.

5. No refunds

A confirmed free claim or paid takeover is a digital service that begins immediately. Payments are final and non-refundable unless mandatory law requires otherwise. Being replaced, receiving fewer visits or clicks than expected, downtime, a broken remote image, or removal for violating these Terms or the Rules does not create a right to a refund.

6. Your content and promises

You keep your rights in content you submit. You confirm that you own it or have permission to use it, that your owner label and claims are accurate, and that the content and destination comply with advertising, consumer, privacy, intellectual-property, and other laws that apply to you.

You grant us a worldwide, non-exclusive, royalty-free license to fetch, validate, proxy, format, reproduce, display, and retain your submitted content and owner label as reasonably needed to operate, moderate, promote, and preserve the public history of Hostile Homepage. The license ends when the material is no longer needed for those purposes, subject to legal records and backups.

7. Prohibited use

You may not submit content prohibited by the Rules; impersonate a person or business; infringe intellectual-property, privacy, publicity, or other rights; direct visitors to malware, phishing, scams, or unsafe downloads; manipulate page-view or click counts; evade security controls; interfere with the service; or use automated access in a way that harms the service or other users.

8. Moderation and complaints

We may reject, hide, disable, or remove content, an ownership record, a link, an image, or an entire position with or without advance notice when we reasonably believe it violates the Rules, these Terms, law, third-party rights, or service safety. The payment and ownership record may remain in the historical database after public content is disabled.

A rights complaint should identify the affected position or content, explain the issue, and state whether you are the rights holder or authorized to act. Send it to legal@kremer-digital.de.

9. Third-party destinations

Owner and content links lead to third-party websites. We do not verify every owner identity, claim, product, or destination and do not endorse them. You visit third-party destinations at your own risk and under their own terms and privacy practices.

10. Availability and changes

The service is provided on an as-available basis and may be slow, unavailable, inaccurate, changed, paused, or discontinued. We may change positions, pricing rules, functionality, or these Terms. The version in effect when a payment is completed applies to that payment, except where a later change is required for law or safety.

11. Disclaimers

To the fullest extent permitted by law, the service is provided without express or implied warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, security, or accuracy. Nothing in these Terms limits a warranty or consumer right that cannot legally be excluded.

12. Limitation of liability

To the fullest extent permitted by law, we are not liable for lost profits, revenue, data, goodwill, opportunities, or indirect, special, incidental, or consequential loss. Our total liability arising from a particular takeover will not exceed the amount you paid for that takeover. These limits do not apply where applicable law forbids them, including liability that cannot be excluded for intentional misconduct, gross negligence, or injury.

13. Governing law and venue

Governing law and venue are determined by the mandatory conflict-of-law and jurisdiction rules that apply to the operator and you. These Terms do not remove any mandatory protection or local court access available to a consumer.

14. General

If one provision is unenforceable, the rest remains in effect. A delay in enforcement is not a waiver. These Terms, the Rules, the Privacy Policy, and the checkout details form the agreement for the service.
